As outlined in our recent client advisory, in response to the recent introduction of digital accessibility regulations under Title II of the Americans with Disabilities Act (ADA) by the United States Department of Justice (DOJ), compliance deadlines have been set for public entities. These deadlines, crucial for ensuring equal access to digital platforms for individuals with disabilities, also have significant implications for private sector businesses partnering with governmental organizations.

The compliance deadlines for public entities are as follows:

Large entities: April 24, 2026

Small entities: April 24, 2027

These deadlines mark the timeframe within which public entities are required to achieve compliance with the digital accessibility regulations. It is important for private sector partners to take note of these deadlines as they navigate their collaborations with governmental organizations.

Failure to comply with these regulations can have significant consequences, including potential loss of government contracts, litigation, and reputational damage. Private sector entities may face increased pressure from their governmental customers to ensure full compliance with the WCAG 2.1 Level A and AA standards.

It is important for private sector companies to assess their current practices and capabilities to ensure they can meet the requirements set forth by the DOJ. This may involve updating existing digital platforms, products, and services to align with accessibility standards, as well as providing accessible documentation.
