Artificial Intelligence (AI) technology has nearly limitless applications across various domains, including telecom, where it can be used for network traffic analysis and interactive communication with consumers. Concerned about AI’s ability to supercharge illegal robocall and robotexts campaigns and the related privacy issues, the Federal Communications Commission (FCC) Chairwoman Jessica Rosenworcel suggests harnessing AI’s analytical possibilities to combat these illegal activities.

The FCC Chairwoman Jessica Rosenworcel announced yesterday that she will be sharing with the FCC Commissioners a proposed Notice of Inquiry that would investigate how AI impacts illegal and unwanted robocalls and robotexts. The proposal will be voted on at the FCC’s next open meeting on November 15. If it is adopted (which is almost certain to happen), the FCC would commence a formal inquiry into the use of AI technology to protect customers from unwanted robocalls and robotexts under the Telephone Consumer Protection Act (TCPA).

The FCC Chairwoman expressed her caution about the potential challenges AI can present but noted the “significant potential to use this technology to benefit communications networks and their customers—including in the fight against junk robocalls and robotexts.”

If adopted on November 15, the Notice of Inquiry would seek comment on the following items:

  • How AI technologies fit into the Commission’s statutory responsibilities under the TCPA;
  • If and when future AI technologies fall under the TCPA;
  • How AI impacts existing regulatory frameworks and future policy formulation;
  • If the Commission should consider ways to verify the authenticity of legitimately generated AI voice or text content from trusted sources; and,
  • What next steps, if any, are necessary to advance this inquiry.
