FCC Enforcement Bureau Proposes Penalties for Broadband Data Collection Non-Compliance
On September 10, 2024, the FCC’s Enforcement Bureau issued Notices of Apparent Liability for Forfeiture (NALs) against several companies for failing to submit required broadband data as part of the Broadband Data Collection (BDC) program. The companies named in the NALs include:
- Metro Wireless
- Centex Web Access
- Particle Communications Wholesale
- BySky
- Lobo Internet Services
- Antelecom
- SignalNet
- Mobile Communications
- Sonic Spectrum
Penalties Proposed
The Enforcement Bureau proposed penalties ranging from $15,000 to $30,000 for each company, depending on the severity and context of their violations. These penalties are meant to signal the FCC’s commitment to accurate broadband mapping and ensuring compliance with national broadband standards.
Key Compliance Obligations
Facilities-based providers of Broadband Internet Access Service (BIAS) are required to submit data under the BDC program on a bi-annual basis to ensure the FCC has accurate and up-to-date information on service availability, speeds, and coverage. Failure to do so may result in monetary penalties, such as those proposed here, as well as potential future enforcement actions if non-compliance continues.
