California Public Utilities Commission Orders Licensed Communications Companies to Respond to a Detailed Data Request Within 30 Days

On June 29, 2021, as part of a California Public Utilities Commission (“CPUC”) proceeding reviewing funding mechanisms for the state’s Public Purpose Programs, the Administrative Law Judge overseeing the case issued a memorandum that includes an extensive data request for information (the “Data Request”). All communications companies licensed by the CPUC must respond to the Data Request by July 28, 2021.

The Data Request applies to all communications providers with an active California certificate of public convenience and necessity, Wireless ID Registration, or NDIEC registration.  These licensed communications providers must file the following information with the CPUC:

  • Contact information and basic company identifying information;
  • Detailed information on the number of California subscribers in calendar year 2020; and
  • Detailed revenue data for calendar year 2020. If the revenue totals do not match the amounts reported in FCC Form 477 or Telecommunications and User Fee Filing System (“TUFFS”) filings for 2020, detailed documentation explaining the discrepancies must be provided.

Companies with multiple licenses must file separately for each license.

Responsive filings must be submitted via e-mail to the CPUC Communications Division’s inbox at CD.Surcharges@cpuc.ca.gov. Upon receipt, review, and analysis of all submissions, the CPUC will invite further comment from interested stakeholders.

Additional filing instructions can be found in Attachment A to the memorandum containing the Data Request. The Excel version of the Data Request Template that must be used for these filings will be posted to the surcharge and fee Order Instituting Rulemaking web page. The Data Request Template and filing instructions will also be provided to all communications companies listed in the Commission’s Utility Contact Information System that report revenue and remit surcharges through TUFFS.
